Yeah, that would be the Miller test which was definded in Miller vs. California, so lolicon in general appears to be legal, but some images maybe illegal in some areas. Given the global nature of the internet and that definition of obscenity it's been very hard for authorities to get material ruled obscene.

The new site policy was a response to a law some thought outlawed lolicon. If it turns out to be the case that lolicon is legal I suspect the policy will revert back (that's only my opinion and speculation).
